Applying the Mental Capacity Act During Cancer Screening of People with a Learning Disability
The following video has been produced on behalf of Surrey and Sussex Cancer Alliance by AUTEK CIC and Dimensions UK, with development and input from NHS Sussex LeDeR team and Cancer Interface team. It provides guidance to healthcare professionals in applying the Mental Capacity Act during cancer screening of people with a learning disability.
We all need to know how to apply the Mental Capacity Act in our daily work. Learning from the lives and deaths of people with a learning disability (LeDeR) continues to identify poor understanding and application of the Mental Capacity Act. Designed to be watched as a whole or just the first half this film, by people with a learning disability (including the soundtrack), will make you think about why we have this important piece of enabling human rights legislation. The second half; assessing capacity and determining best interest for the decision to undertake a colonoscopy, is designed to make you think about how you might formulate and record a conversation to demonstrate you have undertaken a proportionate but robust capacity assessment and followed the principles of best interest for decisions you are clinically responsible for.
